General terms of use of the website and the services offered
Use of the website implies full and complete acceptance of the general terms of use described below.
These terms of use may be amended or supplemented at any time; users of the website are therefore invited to consult them regularly. This website is normally accessible to users at all times.
However, the owner may decide to interrupt access for technical maintenance, in which case the owner will endeavour to inform users of the dates and times of the work beforehand. The website is updated regularly by the publication director.
Likewise, the legal notice may be amended at any time: it is nonetheless binding on users, who are invited to refer to it as often as possible in order to acquaint themselves with it.
Description of the services provided
The purpose of the website is to provide information about all of the owner’s activities. The owner endeavours to provide information on the website that is as accurate as possible. However, the owner cannot be held liable for omissions, inaccuracies or failures to update, whether caused by the owner or by the third-party partners who provide this information. All the information shown on the website is given for guidance only and is subject to change.
Furthermore, the information on the website is not exhaustive. It is given subject to any changes made since it was published online.
Contractual limitations on technical data
The website uses JavaScript technology. The website cannot be held liable for material damage linked to the use of the website. In addition, the user of the website undertakes to access the website using recent equipment that does not contain viruses and with an up-to-date, latest-generation browser.
Intellectual property and infringement
BOUME owns the intellectual property rights to, or holds the rights of use for, all the elements accessible on the website, in particular texts, images, graphics, logo, icons, sounds and software. Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the website, by whatever means or process, is prohibited without the prior written permission of the owner. Any unauthorised use of the website or of any of the elements it contains will be regarded as infringement (contrefaçon) and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code (Code de la propriété intellectuelle).
Limitation of liability
The owner cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing the website, resulting either from the use of equipment that does not meet the specifications set out in the “contractual limitations on technical data” section, or from the appearance of a bug or an incompatibility. Nor can the owner be held liable for indirect damage resulting from the use of the website.
Personal data management
In France, personal data are protected in particular by Law No. 78-87 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L. 226-13 of the French Criminal Code (Code pénal) and the European Directive of 24 October 1995.
When the website is used, the following may be collected: the URL of the links through which the user accessed the website, the user’s internet service provider and the user’s Internet Protocol (IP) address.
In any event, the owner only collects personal information about the user where this is required for certain services offered by the website. The user provides this information in full knowledge of the facts, in particular when entering it him- or herself. The user of the website is then informed whether or not providing this information is mandatory. In accordance with the provisions of Articles 38 et seq. of Law 78-17 of 6 January 1978 on information technology, data files and civil liberties, every user has a right of access to, rectification of and objection to the personal data concerning him or her, by making a written and signed request, accompanied by a copy of an identity document bearing the holder’s signature, and stating the address to which the reply should be sent.
No personal information about the user of the website is published without the user’s knowledge, or exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only in the event of the acquisition of BOUME and its rights could such information be passed on to the potential acquirer, who would in turn be bound by the same obligation to store and modify the data with regard to the user of the website.
The website has not been declared to the CNIL (the French data protection authority) because it does not collect personal information. Databases are protected by the provisions of the Law of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.
